This policy describes how SongFromWithin collects, uses and retains data in connection with providing the service. By using the service, you agree to the terms described below.
1. Data we collect
We collect account data (email, name), order data you voluntarily enter (occasion, information about the recipient, story, musical preferences), and technical usage data (logs, browsing statistics). Payment data is processed directly by our payment provider and never passes through our servers.
2. Sole responsibility of the customer regarding third-party recipient data
Information about the person receiving the song is provided by you, on your own initiative and under your sole responsibility. You warrant that you have any right or legitimate basis necessary to share this information with us. SongFromWithin acts as a mere technical processor based on the information you entrust to it and cannot be held liable for any failure on your part to meet this obligation.
3. Photos provided for the lyric video
If you choose the lyric video with your photos (Prestige plan), you send us photographs that may show people, including the recipient of the song. You guarantee that you have the right to use them and, where people appear in them, that you have their agreement. These photos are used only to create your video: they are processed by our video rendering infrastructure and built into the final video, then deleted from our servers as soon as the video is created, and at the latest 30 days after they were uploaded if the video was never started. They are not used to train artificial intelligence models and are not shared for any other purpose. The resulting video can be downloaded for 7 days from the moment you accept your song (and at the latest 30 days after it is created if the song is never accepted), then it is permanently deleted from our servers: we cannot keep videos indefinitely. Remember to download it before then.
4. Purposes and use of data
Your data is used to provide the service, personalize your song, ensure security and fraud prevention, and for the continuous improvement of our generation models, including training or fine-tuning AI models based on aggregated or anonymized data. We may also send you communications about the service or offers, from which you can unsubscribe at any time.
5. Data sharing
We share certain data with our technical providers strictly necessary for the service to function (hosting, payment processing, email delivery, audio generation infrastructure). We do not sell your personal data to third parties for independent commercial purposes.
6. Retention period
We retain your data for as long as necessary to provide the service, comply with our legal, accounting and tax obligations, manage disputes, and continuously improve our models in anonymized form, including beyond the closure of your account where justified by these purposes.
7. Your rights
In accordance with applicable regulations, you have a right to access, rectify, erase, object to and port your personal data. These rights are exercised by contacting our support and may be limited where their exercise would conflict with our legal retention obligations, particularly accounting-related, or with an ongoing dispute.
8. Security
We implement reasonable and proportionate security measures to protect your data. However, as no system is infallible, our liability in the event of a security incident beyond our reasonable control shall not exceed the applicable minimum legal obligations.
9. International transfers
Some of our technical providers may be located outside your country of residence, including outside the European Union. We ensure that such transfers rely on appropriate safeguards recognized by applicable regulations.
10. Cookies and similar technologies
The site uses technical cookies necessary for it to function, as well as analytics and personalization cookies subject to your consent, manageable at any time via our cookie management banner.
11. Changes
This policy may be changed at any time to reflect changes in the service or applicable regulations. The version in force is the one published on this page at the time you use the service.
